Binding Agreement
These Terms of Service (the “Terms”) govern the use of NexGen Labs’ website (the “Site”) by you, the individual (“you,” “your,” or “user”) and any services made available to you on or through this Site (the “Services”), which is owned and operated by NexGen Labs (hereinafter, “NexGen Labs,” “Company,” “We,” “Us,” or “Our”). These Terms constitute a legally binding agreement between you and NexGen Labs. If you are using the Site or Services on behalf of a company or another business entity, then “you” or “user” includes your company or such other entity, its officers, members, agents, successors, and assigns, together with you. If you are registering as a business entity or seller, you represent that you have the authority to bind the entity to these Terms. By using the Site, you agree to be bound by these Terms and all additional policies referenced herein.
Scope of the Agreement
Our Services are available only to individuals who are over 18 years of age and can enter into legally binding contracts under applicable law. Our Services for sellers are only available to persons or entities authorized to conduct business under applicable regulations.
These Terms shall be governed by and construed in accordance with the laws of India without reference to conflict of laws principles. Disputes arising in relation hereto shall be subject to the exclusive jurisdiction of the courts at Bengaluru, India.
Terms of Sale
By placing an order with us, you agree to purchase the selected product (“Product”) in accordance with the terms on the Site, including pricing, descriptions, shipping, returns, replacements, and refunds as outlined in the respective policies. You also represent that you are of legal age and that all provided information is accurate. You confirm that you are authorized to use the payment methods used for the purchase.
NexGen Labs does not guarantee the quality, safety, or legality of any Products purchased. The Products are the sole responsibility of the seller. The user acknowledges this risk and agrees to indemnify NexGen Labs against any claims or demands arising due to discrepancies in product descriptions or user expectations.
Purchases can only be retracted if explicitly allowed in the seller’s terms or in cases where the seller materially changes the product description after a sale, defaults in delivery, or otherwise fails to fulfill their obligations.
Product images and videos on the Site are for demonstration purposes only. Actual products may vary in color, size, or shape due to manufacturing variations. Billing & Payments
All supplied items will be accompanied by an official GST invoice. Orders paid in advance will be dispatched upon confirmation of payment.
Delivery
Orders are generally processed and shipped within 1-2 working days after order confirmation. Certain products may have different lead times due to their nature. If a product is delayed beyond standard timeframes, the buyer will be informed accordingly. If a product goes out of stock post-order placement, the buyer will be notified, and necessary refunds will be processed.
Due to logistical constraints, some locations may not be serviceable. If an order cannot be fulfilled due to delivery restrictions, the buyer will be informed.
Logistics
NexGen Labs relies on third-party logistics services for shipping. NexGen Labs is not responsible for delivery delays, damages, or misconduct by courier personnel. However, we prioritize customer satisfaction and encourage reporting such incidents for resolution under our returns/refund policy.
Shipping Charges & Taxes
Applicable shipping and handling charges will be displayed at checkout. Partial shipments may be made at NexGen Labs’ discretion, without relieving the user from obligations for remaining deliveries.
Privacy & Use of Customer Information
By using our Site and Services, you consent to the collection and use of your personal data as outlined in our Privacy Policy. NexGen Labs may use customer information, including names, contact details, and emails, for service-related activities such as product promotions, inquiries, and advertisements.
You agree not to:

Disclaimer of Warranties & Limitation of Liability
NexGen Labs does not warrant the continuous availability, accuracy, or quality of its Services, Products, or content. We are not liable for damages arising from: (a) Inability to use the Site or Services; (b) Unauthorized access or data alterations; (c) Any other service-related issues.
You agree to indemnify and hold NexGen Labs harmless against claims, including legal fees, resulting from your breach of these Terms or any third-party rights violations.
General Provisions

- These Terms override any conflicting seller-imposed conditions.
- Failure to enforce any provision does not constitute a waiver of rights.
- No verbal explanations alter the Terms.
- NexGen Labs reserves the right to modify these Terms at any time.
Severability
If any provision is deemed invalid or unenforceable, the remaining provisions shall continue in full effect.
Termination
NexGen Labs reserves the right to suspend or terminate Services without notice. Upon termination, user content may be deleted without liability.
